This website is operated by Kovara Pty Ltd (ABN 60 696 728 944), trading as KOVARA.
By accessing this website or purchasing products from KOVARA, you agree to these Terms of Service.
Products
We make reasonable efforts to ensure product descriptions, specifications, images and pricing are accurate.
Product images may be illustrative, and minor variations in appearance, packaging or finish may occur where they do not materially affect the product's functionality or specification.
Customers are responsible for confirming that a product is suitable for their intended application before installation or use.
Pricing
Unless otherwise stated, website prices are displayed in Australian dollars (AUD) and include GST.
Approved trade customers may have access to separate trade pricing.
KOVARA reserves the right to change prices and promotions prospectively without notice.
Orders
Placing an order does not necessarily constitute final acceptance by KOVARA.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- an obvious pricing or listing error has occurred;
- payment cannot be verified;
- fraud or misuse is suspected; or
- we cannot reasonably fulfil the order.
If we cancel a paid order, amounts paid for products that will not be supplied will be refunded.
Product Installation and Use
Products must be selected, installed and used appropriately for their intended application.
Where electrical work is required, installation must be undertaken in accordance with applicable Australian laws, regulations and standards and, where required, by an appropriately licensed or qualified person.
Liability
To the maximum extent permitted by law, KOVARA is not responsible for loss arising from improper installation, misuse, unauthorised modification or use of a product outside its intended application.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Intellectual Property
Unless otherwise stated, website content including KOVARA branding, graphics, photographs, product descriptions and other original material is owned by or licensed to Kovara Pty Ltd.
Such material must not be reproduced or commercially used without permission except as permitted by law.
Governing Law
These terms are governed by the laws applicable in Victoria, Australia, and applicable Commonwealth laws.
Australian Consumer Law creates mandatory consumer guarantees, and some businesses purchasing products for business purposes can themselves qualify as consumers—for example, where the purchase costs less than $100,000 including GST
